Learned advocate appearing for the petitioner submits that there was a civil suit filed as against the predecessor-in-interest of the petitioner. Such civil suit was dismissed. He submits that the petitioner is the owner of the immovable property concerned. The private respondent is influential. He is trying to develop the immovable property. He obtained a sanction plan. Petitioner is being pressurized to sell the immovable property. The police did not act on the basis of the complaint of the petitioner. Rather
police tried to impress on the petitioner to compromise with the private respondent.
State, Kolkata Municipal Corporation and private respondent are represented.
Learned advocate appearing for the private respondent submits that the petitioner was the licensee in respect of the immovable property. One room was occupied by the petitioner. Such room is under lock and key. Private respondent did not touch the portion occupied by the petitioner in the construction.
Learned advocate appearing for the Kolkata Municipal Corporation submits that the private respondent obtained sanction for reconstruction of the roof slab of the single storied residential building. Learned advocate appearing for the State submits that the police enquired into the complaint and found that the room spoken of by the petitioner to be under lock and key for two years. The police entered the complaint of the petitioner as a General Diary.
Evidently there are disputes between the private parties with regard to the immovable property. It is for the private parties to avail of their remedies before the appropriate forum in accordance with law. Since the police taking steps, as noted
above, further interference of the Writ Court is not called for.
Accordingly, the writ application being WPA 10907 of 2021 is disposed of.
