IA No.: CAN 2 of 2025 Affidavit-of-service, as filed, is taken on record. This is an application for restoration of the order dated 7th May, 2025.
Having heard the learned advocates appearing for the respective parties, and upon perusal of the averments made in the application, we are satisfied with the explanation offered towards the absence of the learned advocate for the appellants on 7th May, 2025, when the matter was dismissed for default.
Accordingly, the order dated 7th May, 2025 is recalled. The application, being IA No.: CAN 2 of 2025 is disposed of.
The appeal, being MAT 556 of 2018 is restored to its original file and number.
MAT 556 of 2018 Mr. Das, learned advocate appearing for the appellants, has pointed out that by passing an interim order, the operation of the order impugned in the appeal has been stayed till the disposal of the appeal. He prays for re-imposition of that interim order.
Mr. Ahmed, learned advocate appearing for the writ petitioner/respondent no. 1, submits that in the event such interim order is re-imposed, an early date may be fixed for hearing of the appeal, since the paper books have already been filed and the appeal is otherwise ready for hearing.
In view thereof, the interim order passed earlier in this appeal is reinstated. Needless to say, the same will remain operative till the disposal of the appeal. List this appeal for final hearing in the combined monthly list of May, 2026.
