1. Affidavit of service filed in Court today is taken on record.

2. The petitioner's prayer seeking regularization of a plot of land which the petitioner is using as a commercial unit for a considerable period of time is pending consideration at the end of the railway authority.

3. The petitioner intends to take the benefit of the policy which was published by the Railway Board vide no. 97/LML/18/67 dated 26th July, 2004.

4. The petitioner also seeks for a permission to install air condition machine so that the petitioner can use the unit effectively for running his business.

5. Learned advocate representing the railways is yet to receive instruction in the matter.

6. As it appears that the issue is pending consideration before the railway authority, accordingly, the instant writ

petition is disposed of by directing the Senior Divisional Electrical Engineer (G), South Eastern Railway, Kharagpur being the respondent no. 4 herein to take into consideration the representation of the petitioner and to decide the same in accordance with the prevailing guidelines.

7. An opportunity of hearing shall be given to the petitioner for production of all documents in support of its stand.

8. A reasoned order shall be passed and communicated to the petitioner immediately after order is passed.

9. Steps shall be taken in the matter at the earliest but positively within a period of eight weeks from the date of communication of this order.

10. The writ petition stands disposed of.

11. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
