Heard learned counsels for the parties.

The initial prayer of the petitioner was for a direction upon the Inspector in charge, Egra Police Station to investigate the case registered at the behest of the petitioner.

It is not in dispute that the investigation is complete and charge sheet has been submitted.

Learned counsel for the petitioner submits that the petitioner has submitted an application under Section 173(8) of the Code of Criminal Procedure before the learned Magistrate seeking further investigation.

Learned counsel draws the attention of the Court to an order passed by the learned Magistrate on 16th October, 2025 wherein the learned Magistrate has directed the Inspector in charge, Egra Police Station to arrange for escort and vehicle for safe return of the petitioner Firoja Bibi and her family to her place of residence. Learned counsel for the petitioner was requested to contact the

Inspector in charge, Egra Police Station to finalise the date and time of her return. The Inspector in charge was also directed to ensure that no threat, verbal or physical, was meted out to the petitioner and her family in any manner and also to further ensure the safety and security of the petitioner and her family at all times.

Learned counsel for the petitioner submits that the order has not been complied with by the police authority despite the learned counsel for the petitioner visiting the Police Station for the purpose. Learned counsel submits that the petitioner intends to return to her residential house on 29th October, 2025 at 10.30 am. Since the petitioner is residing elsewhere now, learned counsel for the petitioner shall visit the Inspector in charge, Egra Police Station tomorrow, i.e. on 28th October, 2025 and furnish the present address of the petitioner in order to enable the police authority to arrange for her escort and vehicle therefrom for safe return to her residential house. The Inspector in charge, Egra Police Station shall take all necessary steps for strict compliance of the order passed by the learned Magistrate on 16th October, 2025 in its true letter and spirit.

With the above directions, the writ petition is disposed of.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
