Kausik (Allowed) CRM (NDPS) 919 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Islampur Police Station Case No. 1089 of 2025 dated 15.10.2025 under Sections 20(C)/23(C) of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that he is detained in custody for 8 months for alleged recovery of 20.810 Kgs. of Ganja. Charge sheet has already been submitted and there is hardly any possibility of the trial being taken to its logical conclusion within a reasonable period of time. As such, the petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail.

Having considered the period of detention of the present petitioner since 15.10.2025, the quantum of recovery and the fact that the evidence of the prosecution would take some time, I am of the view that the petitioner be released on bail.

Accordingly, prayer for bail of the petitioners is allowed. Accordingly, Petitioners, namely, (1) Keshab Das, (2) Jyotirmoy @ Jotirmoy Biswas shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Special Judge (under NDPS Act), Raiganj, Uttar Dinajpur.

If on bail, the petitioners shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Uttar Dinajpur without the prior permission of the learned Special Court. Thus, CRM (NDPS) 919 of 2026 is allowed.

Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
