Report submitted by Mr. Madhusudan Sur, learned advocate appearing for the State, which has been prepared by the Officer-in-Charge, Nager Bazar Police Station, be kept with the record.

The report encloses a statement recorded by a SubInspector of Police attached to the concerned Police Station wherein the de facto complainant Ms. Pinki Agarwal submitted that she do not intend to pursue Nager Bazar Police Station Case No.258 of 2022 dated 12.08.2022 under Sections 498A/406 of the Indian Penal Code as the dispute between her and her husband has been resolved and there has been an amicable settlement. To that effect, a joint compromise application has also been filed between the

parties.

I have considered the report submitted by the concerned Officer of Nager Bazar Police Station which encloses the statement along with a declaration being made.

The present case being Nager Bazar Police Station Case No.258 of 2022 dated 12.08.2022 under Sections 498A/406 of the Indian Penal Code arose out of matrimonial dispute. Having considered the fact that there has been an amicable settlement in the matrimonial dispute, I am of the view that further continuance of the proceedings of Nager Bazar Police Station Case No.258 of 2022 dated 12.08.2022 under Sections 498A/406 of the Indian Penal Code along with all orders passed therein before the learned ACJM, Barrackpore be hereby quashed. Accordingly, CRR 1558 of 2023 along with CRAN 1 of 2023 is allowed.

Pending other applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
