Mahata Ms. Sangeeta Roy ..for the State It is submitted by the learned Advocate for the petitioner that the petitioner is a resident of Plot No.1145, Kamarpara Mouza, Post Office Kulagachi, Police Station Kotwali, District Nadia.

It is the contention of the petitioner that a village road has been made a 'pucca road' by the concerned gram panchayat up to the house of Ranjit Pal and Atul Paul but, the portion of the road in front of the dwelling house of the petitioner situated at plot no. 1145 has been left in its original condition without making the same concrete. The reason being political rivalry.

Records reveal that a representation has been made to the Pradhan, Poragachha Gram Panchayat by the petitioner dated June 21, 2019.

Representations have also been made to the other authorities of the district administration.

It is submitted that none of the authorities have paid any heed to the repeated requests of the petitioner for construction of the concrete road in front of the petitioner's house.

It is submitted that during monsoon the area becomes inundated in water and the petitioner and his wife who are suffering from several illnesses find it very difficult to visit the doctor and the hospital. The infrastructural facilities should be improved, according to the petitioner.

Under such circumstances, without going into the merits of the claims and counterclaims of the parties, this writ petition is disposed of with a direction upon the Pradhan, Poragachha Gram Panchayat to consider and dispose of the representation of the petitioner dated June 21, 2019 in accordance with law within a period of six weeks from the date of communication of this order. The concerned Gram Panchayat shall hold an inspection of the premises in question and if it is found that the contentions of the petitioner is correct, then steps should be taken in accordance with law. A reasoned order should be passed and communicated to the petitioner. The petitioner shall also be heard and allowed to submit proper documents before the authority concerned.

This writ petition is thus disposed of.

There will be however no order as to costs.
