The petitioner renews his prayer for bail which was rejected earlier on June 02, 2021 in CRM 3075 of 2021. The charge is under the provisions of the NDPS Act. The petitioner says that there was no recovery from him. He has been implicated on the basis of statements made by the co-accused persons.

It appears from the material in the Case Diary that at the time of seizure of the contraband items of commercial quantity, the petitioner managed to flee. He was arrested after Charge Sheet was submitted.

We have seen the earlier order of rejection and the material in the Case Diary which indicate prima facie complicity of the petitioner in the alleged offence. We are not inclined to entertain the petitioner's prayer for bail, at this stage.

The application for bail being CRM 4410 of 2021 is, thus, dismissed.
