Learned advocate for the petitioner contends that 24.06.2025 Court No. 35 M/L. 14 Rakib in spite of a Civil Suit being T.S. 345/2023 pending and an order of status quo in respect of not to change the nature and character of the property being passed by the learned Civil Judge (Senior Division), Kharagpur, the private respondent are attempting to change the nature and character of the property.

State has submitted a report. Report reflects that the police authorities have conducted an enquiry in respect of the representation so made. According to the police authorities on local enquiry it was found that there has been no change in the nature and character of the said land and the same was left fallow after the winter crops were harvested.

Having considered the steps taken by the police authorities, I am of the view that the nature of the dispute relating to the land in question is already being dealt with by the learned Civil Judge (Senior Division), Kharagpur. In case of any dispute relating to the said property,

appropriate applications be made for exhausting remedies available before the Civil Court by the petitioner or the respondents.

So far as the police authorities are concerned, they have limited scope in interfering in such situation. However, the police authorities are directed that they would keep a strict vigil and ensure that no breach of the peace and/or tranquility or any untoward incident results because of the strained relationship existing between the parties.

With the aforesaid observations WPA 10187 of 2025 is disposed of.

Report submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
