C.R.R. 1996 of 2025 In the matter of:- Dr. Parimol Chandra Acharjee @ Parimal Chandra Acharjee Mr. Amit Singh Ms. Rita Agrahari ...for the petitioner Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the 68 years old complainant in a case under Section 138 of the N.I. Act. Although he filed the petitioner's complaint in 2019, till date the proceeding could not be concluded. In fact, due to non-appearance of the accused, a warrant of arrest has been issued earlier. But, the same could not be executed. Then the petitioner prayed for substitution of the address of the accused. The same was allowed. But, summons could not be served. Now, long dates are being fixed by the learned trial Court.

No prejudice will be caused to anyone if a direction is passed to expedite the proceeding.

It appears that there is an inordinate in conducting the proceeding of Complaint Case No. 499 of 2019 pending before the learned Judicial Magistrate, 5th Court, Barrackpore, North 24 Parganas.

In view of the same and in the interest of justice, I request the learned trial Court to conclude the proceeding

as expeditiously as possible by fixing shorter dates and by taking stern steps for ensuring the attendance of the accused.

With these observations and directions, the revisional application is disposed of.
