The only grievance of the writ petitioner/ appellant is that a successful candidate has been allotted 3 marks extra by the Selection Committee by reason whereof the total marks obtained by that candidate is in excess of the marks obtained by the appellant. He contended that the Selection Committee had no authority to allot the extra 3 marks.

Today, learned Advocate appearing for the State has produced the relevant Notification wherefrom it appears that a candidate for the post of Sahayak of Gram Panchayet, who has secured 50% marks in aggregate in Madhyamik or equivalent examination, will be allotted 3 marks on that account. Learned

Advocate says that this is what was done in the case of all successful candidates.

Copy of the Notification be kept with the records. Particular grievance has been made by the writ petitioner in respect of one Basudeb Mohanta. We find that since he got more than 50% marks in Madhyamik, he was allotted 3 marks extra as prescribed in the relevant Notification.

The other ground on which the learned Single Judge dismissed the writ petition is that the successful candidates have not been impleaded as parties. This amounted to non-joinder of necessary parties. We agree with the learned Judge.

In view of the aforesaid, we see no reason to interfere with the order under appeal.

MAT 604 of 2021 along with IA CAN 2 of 2021 is, accordingly, dismissed.
