Learned advocate appearing for the petitioners submits that the petitioner nos. 1 and 3 were arrested during the pendency of the application.

In view of the arrest of the petitioner nos. 1 and 3, the application is treated as dismissed as not pressed on their behalf. State is represented.

Considering that the husband was granted bail by the jurisdictional court, we are inclined to grant anticipatory bail to the petitioner no. 2 (Jhunu Banik).

Accordingly, we direct that in the event of arrest, the petitioner no. 2 (Jhunu Banik) shall be released on anticipatory bail upon furnishing a bond of Rs.10,000/-(Rupees Ten Thousand Only), with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioner no. 2 (Jhunu Banik) shall appear before the jurisdictional court and pray for regular bail within four weeks from date and petitioner no. 2 (Jhunu Banik) shall cooperate with the investigation.

The prayer for anticipatory bail is allowed.

CRM 4406 of 2021 is disposed of.
