Mr. Bidyut Kumar Halder, Mr. Indranil Halder ...for the petitioner Dr. Madhusudan Saha Roy ...for the CESC Limited Learned counsel appearing for the CESC Limited, by placing reliance on a copy of a communication dated April 20, 2022 made by the CESC Limited to the petitioner, reiterates that the petitioner is already enjoying an electricity connection at the ground floor of the premises-in-question. Since a new connection has been sought on the ground floor, the CESC Limited is unable to give the same. However, in the event the petitioner seeks transfer of name of the existing electric meter to his name, the CESC Limited has no impediment in granting such transfer subject to compliance of all formalities by the petitioner.

Learned counsel appearing for the petitioner submits, on instruction, that the petitioner is agreeable to

apply, if not possible for a new connection, for a transfer of the existing meter in his name.

Hence, W.P.A. No. 9738 of 2022 is disposed of by granting liberty to the petitioner to apply before the Senior Commercial Executive of the CESC Limited, as indicated in the communication handed over in Court today, for transfer of name in respect of the existing meter.

If so approached, the appropriate authority shall look into the matter and permit such transfer, subject to compliance of all necessary formalities by the petitioner, within seven days from the compliance.

It is made clear that the rights of the petitioner in respect of the ground floor of the property has not been entered into while deciding the writ petition. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
