Kausik (Rejected) CRM (NDPS) 933 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bud Bud Police Station Case No. 123 of 2023 dated 01.11.2023 under sections 21(C)/25 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years and 8 months and till date only 4 witnesses have been examined out of the 9 witnesses relied upon. There were earlier directions by this Court, according to the petitioner which have not been complied with.

Learned advocate for the State on the other hand submits that prosecution overall will rely upon 6 witnesses of which, 4 witnesses have already been examined. 2 more witnesses are left to be examined. The subject matter of the

case, according to the prosecution relate to alleged recovery of 8000 bottles of Phensedyl.

Having considered the advance stage of the case, I direct the learned Special Court to complete the evidence of the two Investigating Officers by 15th August, 2026, within 45 days thereafter to complete the examination under Section 313 of the Code of Criminal Procedure and at the earliest thereafter pronounce the verdict if the defence do not intend to rely on any witness.

With the aforesaid observations CRM (NDPS) 933 of 2026 is dismissed at this stage.

Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
