Learned advocate for the petitioner submits that the petitioner has been enjoying the property/land being dag no. 5203, Khatian No. 8529 and 2290 J.L. No. 20, Mouza Jalaberia P.S. Kultali. Learned advocate submits that all on a sudden it is found that the government officials have installed a board which was at the behest of the Kultali Panchayat Samiti. However, the petitioner insists that the same has been done at the behest of the private respondent no.6 being the Officer-in-Charge of Kultali Police Station.

Learned advocate appearing for the State has submitted a report. According to the report the Inspectorin-Charge of Kultali Police Station has specifically contended that the enquiry/finding in the PS record reflects that the construction work which has been

initiated is relating to Government Sanctioned Children Park.

Be that as it may, the nature of the dispute is such that the police authorities are not in a position to assist the individual until and unless the petitioner is in a position to show that there has been any criminal offence having been committed. If the petitioner has issues relating to the title deed, the petitioner claims to be his own, petitioner will approach the appropriate authority and if any direction is passed upon police authorities by appropriate authority concerned, police authorities would respect, obey and implement such order.

In the meantime, police authorities would see that there is no breach of the peace at the property in question.

With the aforesaid observations WPA 10301 of 2025 is disposed of.

Report submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
