Mr. Binoy Kumar Panda along with Mr. Pravas Bhattacharya, learned Advocates who usually appear on behalf of the State are requested to appear in this revisional application. Learned Legal Remembrancer is requested to regularize the appointment of Mr. Binoy Kumar Panda and Mr. Pravas Bhattacharya learned advocates in due course.

Learned Advocate on behalf of the petitioner appears and submits that none appears in this revisional application after 22.6.2011 and there is no stay in the case also.

From the record it appears that this revisional application under Section 482 of the Code of Criminal Procedure was directed against Order No. 5 dated 29.4.2011 passed by the learned Additional District & Sessions Judge Fast Track Court-III, Barasat, DistrictNorth- 24 Parganas in connection with Criminal Revision No. 27 of 2011 dismissing the Criminal Motion by upholding the order dated 19.1.2011 under challenge.

On careful perusal of the record, I find that the learned Additional District & Sessions Judge in Criminal Revision No. 27 of 2011 affirmed the order of the learned Magistrate, 2nd Court, Barasat in connection with M.Case No. 343 of 2010 under Section 125 of the Code of Criminal Procedure.

Now at this stage, this is not desirable for this court to interfere with the order already affirmed by the learned Additional District &

Sessions Judge in revision.

In the aforesaid view of the matter while parties are not interested to proceed with this revisional application further, I do not find any reason to continue with this revisional application further.

Thus, the revisional application stands dismissed. The learned Registrar (Judicial Services) is requested to communicate this order to the learned Judicial Magistrate, 2nd Court, Barasat, District North 24-Parganas forthwith. (Bibhas Ranjan De, J. )
