1. This appeal is directed against the order dated 05.05.2021 passed in WPA 9844 of 2022. This pertains a tender by the respondent oil company.

2. By efflux of time the entire matter has become academic and nothing would survive for adjudication at this juncture.

3. Therefore, the appeal stands dismissed.

4. However, the disposal of this appeal will not in any manner prejudice the rights of the appellant in any other collateral proceeding if the same are still pending.
