Mr. Narayan Prasad Agarwala, learned advocate, and Mr. Pratick Bose, learned advocate, who usually appear on behalf of the State, are present in Court. They are requested to appear on behalf of the State in this matter. Their appointment may be regularized by the learned Public Prosecutor of this Court.
The revisional application is taken up for hearing. Learned lawyer on behalf of the State appears and submits that order of this Court passed on 14-11-2011 has not been complied with.
From the revisional application, it is found that challenge in this revisional application is the order dated 31st July, 2010 passed by the learned Judicial Magistrate, Bidhannagar, North 24-Parganas, in connection with Case No.C/27/2010 whereby learned Magistrate passed an order of maintenance. On a careful perusal of the order impugned, I do not find any illegality or irregularity in the order itself. That apart, it is not seen from the record whether the petitioner has complied with the direction of depositing Rs.50,000/- in the learned court below within two weeks from the date of order passed on 14-11-2011.
Considering all facts and circumstances, I do not find any reason to continue with this revisional application. That being the position, the revisional application stands dismissed. Let a copy of this order be communicated to learned Judicial Magistrate, Bidhannagar, North 24-Parganas, through the learned Registrar, Judicial Service, of this Court. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. Urgent photostat certified copies of this order, if applied for, be supplied to the parties on compliance of all necessary formalities.
