Petitioner is aggrieved by the fact that inspite of the order passed in T.S. 551/2024 by the learned Civil Judge (Junior Division), Basirhat, thereby directing the defendants and his men and agents from not disturbing peaceful possession of the plaintiff and changing the nature and character of the suit property, it has been complained that the petitioner was forced to leave her residence.

Petitioner complains that she has her valuables at the residence which the private respondents have grabbed. Consequently the petitioner has been thrown out from her residence inspite of the directions passed by the learned Civil Court.

State has submitted a report.

Report acknowledges the fact that the learned Civil Court has passed an injunction order and subsequently on receipt of the information so furnished Hasnabad P.S. Case no.

276/25 dated 19.05.2025 has been registered for investigation.

I find that the accusations relate to forgery of the title deed which has been, prima facie accepted by the police authorities, as such they have registered the case. Consequently, I direct the learned Civil Court to ensure that the order so passed earlier thereby granting ad interim injunction in favour of the petitioner, if requires any compliance with the assistance of the police authorities on an appropriate application being preferred, the same may be directed for being implemented. Police authorities would ensure on receipt of the order from the learned Civil Court that the said order is respected, obeyed and given effect to.

In the meantime, police authorities would ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting from the inimical relationship existing between the parties.

With the aforesaid observations WPA 10234 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
