Learned advocate appearing for the petitioner submits that the petitioner and another has been implicated on alleged recovery of 1 kg. 512 grams of Heroin. Charge has already been framed in the month of January 2026, but till date witness action has not commenced.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that commercial quantity of contraband has been recovered. Having regard to the quantum of seizure in the present case, I am of the opinion that the petitioner has failed to overcome the rigours of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected at this stage. However, the prosecution must know that for indefinite period accused cannot be kept in custody. Accordingly, the learned Trial Court would expedite the

process of trial, at least, on each and every month, examination of one witness must be completed to take the trial to its logical conclusion.

The application for bail, being CRM (NDPS) 936 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
