Kausik (Rejected) CRM (NDPS) 938 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Lalgola Police Station Case No. 852 of 2025 dated 25th September, 2025 under Section 21(C)/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that petitioner is in custody for 8 months and 28 days. He is innocent of the charges but is unnecessarily languishing in jail. Learned advocate for the State, on the other hand, submits that commercial quantity of contraband was recovered from the house where the petitioner stays along with his brother.

Be that as it may, having regard to the fact that charges till date have not been framed, at this stage, I am not inclined to release the petitioner on bail.

As such, prayer for bail of the petitioner in CRM (NDPS) 938 of 2026 is rejected.

Petitioner will renew his prayer for bail after the stage of consideration of charges are over.

Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
