The wife had prayed for expeditious disposal of the Matrimonial Suit No.545 of 2019, which is pending before the learned Additional District Judge, 4th Court at Purba Bardhaman. This court found that the prayer was innocuous and directed the learned trial court to dispose of the matter expeditiously, upon granting equal opportunity to all the parties to expedite the same.

The husband has filed this application for review on the ground that he is in the merchant navy and is working for a foreign company. He is required to travel abroad for his job and stays abroad for more than 12 months and as such the order of expeditious disposal would be detrimental to him. He will not be able to contest the suit properly.

The court had directed the learned trial judge to provide adequate opportunity to both the parties to contest the suit. The husband was always at liberty to make his prayers before the learned court for suitable dates, but without procrastinating the suit He could also pray for adducing evidence, virtually. This court does not deem it necessary to review the order, but modifies the order.

The review application and the connected application stand disposed of accordingly.
