59.
24.08.2021 Ct.32 Tanmoy Rejected C.R.M. 4420 of 2021 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure filed on 30/06/2021 in connection with N case No. 195/2018 arising out of Bagdah Police Station Case No. 700/18 dated 01/11/2018 under Section 21(C) of the N.D.P.S. Act, 1985.
And In the matter of: - Sukanta Bala ....petitioner.
Mr. Angshuman Chakraborty ...for the petitioner.
Mr. Binay Panda, Mr. S. Bhakat, Ms. Puspita Saha ...for the State.
Commercial quantity of codeine mixture was recovered from the possession of the petitioner. In view of the statutory restriction in Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985, we are not inclined to entertain the petitioner's prayer for bail.
The petitioner says that he is in custody for about 2 years and 6 months. In view of such long detention, we request the learned trial Court to expedite the consideration of charges and generally bring the trial to its logical conclusion as soon as the business of the Court may permit.
Accordingly, the application for bail being C.R.M. 4420 of 2021 is dismissed.
