The case relates to appointment in the post of Auxiliary Fire Operator. The petitioner participated in the recruitment process.

The petitioner was directed to appear in an endurance test which was held in January 2023 and he was found to be disqualified.

Learned counsel for the petitioner submits that the petitioner secured more marks than the last empanelled candidate. As per the order of the Court, he ought to be given appointment, as he secured more marks than the last engaged candidate in the district.

Learned counsel for the State has produced before this Court the result of the endurance test. It appears therefrom that the petitioner failed to complete the running with delivery hose (80M) within 14 seconds.

In the other categories where the petitioner was assessed, he may have secured more marks than the last engaged candidate; but as he failed to

complete the run within the qualifying time period, the rest of the marks obtained by him will not make him eligible for appointment.

The respondent authorities have fixed the manner of endurance test of a candidate to be engaged as Auxiliary Fire Operator. If the candidate is unable to run within the qualifying time period, he will be ineligible for selection.

As the petitioner failed to conclude the run within the prescribed qualifying time period of 14 seconds, he has rightly not been considered for appointment. The petitioner completed the run in 14.9 seconds.

In view of the above, the petitioner is not entitled to any relief as prayed for. The writ petition fails and is hereby dismissed.
