This is an application under section 482 of the Code of Criminal Procedure, 1973 filed by the petitioner for quashing of proceeding being G.R. Case No. 01 of 2012 pending before the learned Chief Judicial Magistrate, Malda arising out of Malda Police Station Case No. 435 of 2011 dated December 30, 2011 under sections 376/506 of the Indian Penal Code including the F.I.R. No. 435 of 2011. The matter was dealt with by a coordinate Bench on April 29, 2015, when direction was given to the petitioner to serve copy of the application upon the opposite parties.

Since thereafter, the matter appeared on several occasions when none appeared on behalf of the parties. Department was directed to issue administrative notice.

It further transpires from the report of the Assistant Registrar-XII dated July 27, 2023 that copy of the revisional application along with annexed documents has been supplied to the learned advocate for the petitioner.

The matter is running in the warning list since February 21, 2025.

Considering all aspects of the matter, this Court is of the view that there is no reason to keep the matter pending in the list. Accordingly, C.R.R. 1166 of 2015 is dismissed for default. Let a copy of this order be sent down to the learned Trial Court by the department forthwith for information and necessary action. (Chaitali Chatterjee (Das), J.)
