Mr. Lahiri, learned counsel, appearing on behalf of the writ petitioner claims that the writ petitioner is entitled to the upgradation of scale of pay for the post of Sheristadar in district court at Howrah pursuant to the notification dated January 24, 2020, vide Notification No.JD/L/2S-23/04 (Pt-VI), issued by the Secretary to the Government of West Bengal. The writ petitioner claims that it is undisputed that he worked in the post of Sheristadar from 2009 till his retirement in 2014. Mr. Lahiri also submits that the said post was re-designated as Chief Administrative Officer.

Mr. Mitra, learned senior Government advocate appearing for the State submits that the representation of the petitioner dated August 7, 2020 is still pending consideration before the committee that has been constituted for implementation of the recommendations of the Shetty Commission.

I find from a report filed by the erstwhile Registrar General, High Court Administration/Respondent no.3 that the recommendations of the Shetty Commission are pending implementation before the relevant committee.

Mr. Pal, learned counsel appears on behalf of the District Judge, Howrah/respondent no.4 and submits that the implementation of the recommendations of the Shetty Commission is pending before the committee concerned. He refers to the report filed by the respondent no.4 affirmed on July 29, 2022. Having heard the parties and considering the materials placed on record, this Court is of the view that the said committee should consider the representation of the writ petitioner in terms of the notification issued by the Secretary to the Government of West Bengal dated January 24, 2020, within a period of 10 weeks from date.

With the direction aforesaid, this writ petition, being WPA 9756 of 2022, is disposed of.
