This revisional application under Sections 397/401 read with Section 482 of the Code of Criminal Procedure was filed against an order dated 20th January, 2015 passed by the learned Judicial Magistrate, Khatra, Bankura in Misc. Case No.112/2013 directing the petitioner to pay an amount of maintenance of Rs.1,500/- per month for wife and Rs.750/- per month for each of the sons.

The matter was dealt with by a Coordinate Bench on 29th April, 2015 when an interim order of stay was granted for a period of eight weeks with a direction to the petitioner to make payment of Rs.2,500/- per month for both wife and two children. Subsequent thereafter, the matter appeared on 19th July, 2023 when on the prayer of the petitioner, the matter was adjourned. On 18th March, 2025, Mr. Souvik Ganguly, learned advocate appeared for the petitioner, when no one appeared on behalf of the opposite parties and on the prayer of the petitioner, the matter was adjourned. Furthermore, the Administrative Notice was directed to be issued.

On perusal of the report, as placed before this Court on 2nd April, 2025, it was recorded that the petitioner is no longer residing at the said listed address and the notice could not be served.

Mr. Souvik Ganguly, learned advocate appeared on behalf of the petitioner and an accommodation was also sought for though he personally submitted before this Court that there is no communication between his client and him.

Accordingly, in view of the above facts and circumstances, this Court finds no reason to keep the matter pending further as the same is pending since 2015.

Hence, the instant revisional application being, C.R.R. 1168 of 2015 is dismissed for default.

Let a copy of this order be forwarded to the learned Trial Court for information and taking necessary action.
