The petitioner is aggrieved by the fact that his client had lodged a complaint with the Gazole Police Station, Malda on 24th March, 2021 as regards the conversion of standing crop that he has cultivated on his land.

It is submitted that the police have not taken any steps despite complaint.

Mr. L.K. Mahata, Counsel for the State submits that the dispute is purely private and civil in nature as has been found by the Gazole Police Station after conducting enquiry. It is further submitted that the land on which the petitioner claims rights is not even demarcated.

This Court is inclined to accept the submissions of the Counsel for the State that the dispute is primarily civil in nature.

The writ petitioner may seek civil remedies in respect of his grievance in accordance with law.

Inspector-in-charge, Gazole Police Station shall, however, ensure that there is no breach of peace in the area and keep a vigil thereat.

In view of the aforesaid, the instant writ petition shall stand disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order on usual undertakings.
