It appears that prayer (a) of the petitioners has been allowed by order passed on July 11, 2024.
Learned counsel for the petitioners submits that Visa of the 1st petitioner has been renewed and he is coming to India on December 03, 2024. He shall remain in the country for about a month. The 1st petitioner undertakes to comply with the notice issued upon him under Section 41A of the Code of Criminal Procedure and cooperate in investigation of the case including responding to the calls of the Investigating Officer as and when required. In view of the above, prayer (b) of the application has become redundant.
In the event the petitioner responds to the notice issued upon him under Section 41A of the Code and cooperates in
investigation of the case, no coerceive steps be taken against the petitioner in connection with the present case. By an order passed on April 25, 2024, this Court directed dispensation of personal appearance of petitioners no. 2 and 3 before the learned Trial Court on condition that they are represented by their learned advocates under Section 317 of the Code of Criminal Procedure.
Learned advocate for the private opposite party has no objection if the said interim order is made absolute provided they appear before the Court personally as and when called for by the learned Trial Court.
Accordingly, the interim relief granted in favour of the petitioners no. 1, 2 and 3 vide order passed on April 25, 2024 is made absolute subject to condition that the said petitioners shall personally appear before the Court as and when called for. With the said observation and direction the revisional application being CRR No. 1643 of 2024 is disposed of. As a consequence CRAN No. 1 of 2024 is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
