Petitioner is in custody for more than three years. He submits there is delay in trial. Accordingly, he prays for bail. 2.

Learned Advocate for the State opposes the bail prayer.

Ms. Trina Mitra, learned Advocate empanelled with the High Court Legal Services Authority is requested to appear in the matter.

We have considered the materials on record. Victim is a minor child. She has implicated the petitioner in the offence of penetrative sexual assault. Her deposition is corroborated by her father.

Under such circumstances, we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.
