Gouranga Pramanik Mr. Subhomoy Paul Mr. Ashis Chakraborty ...for the Petitioner This is an application wherein the petitioner has prayed for a direction upon the court below for expeditious disposal of the proceedings being M-347 of 2024 along with an interim application filed under section 125 of the Code of Criminal Procedure, which is presently pending before learned Judicial Magistrate, 1st Court, Barasat. Being aggrieved by the aforesaid proceedings, learned counsel for the petitioner submits that petitioner/wife filed an application under section 125 of the Cr.P.C. along with a prayer for interim relief on 20th May, 2024. Since then two years have already been passed but neither the interim maintenance application nor the main application have been disposed of so far by the court below.

The petitioner is almost under the threat of starvation along with two children, one of whom is aged about two years. Presently, petitioner is living at the charity of her parents and as such she prayed for a necessary direction upon the court below for expeditious disposal of the maintenance application.

Having heard learned counsel for the petitioner, I find that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice and as such, the service of copy of application upon the opposite party is hereby dispensed with.

Considering the fact that the maintenance application has been filed by a hapless lady with a prayer for maintenance while knocking the door of justice for the last two years, I find that the prayer made by the petitioner is justified and is required to be allowed for securing the ends of justice.

In view of the above, the instant application being CRR 1910 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for disposal of the petitioner's interim maintenance application preferably on the next date of hearing or within a period of four weeks thereafter. After disposal of the interim maintenance application the court below will make its best attempt to conclude the entire proceeding under section 125 Cr.P.C. being M-347 of 2024 as expeditiously as possible.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
