Court No.13 Item No. 5 ap W.P.A. No. 9133 of 2019 Smt. Mamata Devi & Anr.

Versus

The State of West Bengal & Ors.

Mr. Tarak Karan.

...For the petitioners.

Mr. Susanta Kumar Pal.

...For the respondent nos.6, 7, 8 & 9.

Affidavit-of-service filed in Court today be taken on record.

The writ petitioners complain against the private respondents of obstruction in construction of a boundary wall.

The writ petitioners claim to have purchased the property lawfully and have obtained a sanction plan for construction.

Counsel for the private respondents submits that the petitioners' Deed is a forged one and that they have no right in respect of the said property. This Court is of the view that the matter between the petitioners and the private respondents is a land dispute, which may be agitated before an appropriate Civil Court or statutory forum.

Inspector-in-charge, Khardah Police Station shall, however, ensure that there is absolutely no breach of peace in the area.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
