Mr. Subhomoy Paul Mr. Ashis Chakraborty ...for the Petitioner In this application the petitioner has prayed for a direction upon the court below for expeditious disposal of the Complaint Case being C-2032 of 2024 presently pending before learned Judicial Magistrate, 1st Court, Barasat.

Being aggrieved by the inordinate delay caused in disposal of the said application, learned counsel for the petitioner submits that petitioner has filed an application under section 12 of the Protection of Women from Domestic Violence Act, 2005 on 17.10.2024 and since then the matter is pending for disposal though affidavit of assests and liabilities have already been filed by the petitioner on 07.01.2026. Therefore, petitioner prayed for a necessary direction upon the court below for expeditious disposal of the aforesaid proceedings.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice

and as such, the service of copy of application upon the opposite parties is hereby dispensed with.

Having considered the fact that the matter is pending for a considerable period of time for no fault of the petitioner, I find that the prayer made by the petitioner/wife is justified and is required to be allowed for securing the ends of justice.

In view of the above, the instant application being CRR 1911 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the proceeding being C-2032 of 2024, pending before learned Judicial Magistrate 1st Court, Barasat, and to make its best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
