Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than nine months, charge-sheet has already been submitted and alleged recovery is 280 grams of heroin. It has also been brought to the notice of the Court that there are two ingredients which are separate contrabands and which finds its place separately in the scheduled under the NDPS Act. Learned advocate appearing for the State opposes the prayer for bail and submits that charges have already been framed and witness action is about to commence.

I have taken into account the Chemical Examiner's report and relying upon Sentu Seikh -Vs. - State of West Bengal [SLP (Crl.) No. 13987 of 2025], as also the fact that the petitioner is in custody for more than nine months and the prosecution intends to examine

12 witnesses, some time will be required to take the trial to its logical conclusion, as such, petitioner may be released on bail. Accordingly, the petitioner, namely, Rosid Rahaman shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (under NDPS Act), 2nd Court, Berhampore, Murshidabad.

If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Murshidabad without prior permission of the learned Special Court.

Thus, CRM (NDPS) No. 943 of 2026 is allowed.

Memo of evidence submitted by the State be kept with the record.
