The petitioner claims to be a tenant under respondent no. 4 in respect of the premises located at 31, B. K. Paul Avenue, 1st Floor, P.S. Jorabagan, Kolkata - 700005.
The petitioner seeks a separate electricity connection for the said premises.
The learned advocate appearing for respondent no. 4 denies the petitioner's status as a tenant.
The learned advocate representing the Calcutta Electricity Supply Corporation (CESC) Limited submits that the petitioner has been found to be in possession of the premises.
It is further submitted on behalf of CESC Limited that the corporation is willing to provide an electricity connection to the petitioner within fortyeight (48) hours, subject to compliance with all requisite formalities, if the same have not already been fulfilled.
In my view, since the possession of the petitioner is not in dispute, irrespective of his alleged tenancy rights, the petitioner ought to be provided with an electricity connection.
Accordingly, the writ petition is disposed of with a direction upon CESC Limited to provide electricity connection to the petitioner at the premises in question from the existing meter board within a period of forty-eight (48) hours from the date of this order, subject to compliance with all formalities.
It is made clear that the grant of electricity connection shall not confer any equitable or proprietary right in favour of the petitioner. Accordingly, WPA 10236 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
