The writ application has been preferred being aggrieved by the recovery notice dated 22.04.2026 issued by the respondent authorities putting into execution its order under Sections 14B and 17Q of the EPF Act, dated 31.05.2024/10.07.2024.

Learned counsel for the petitioner has placed the document at page 54 of the writ application where it appears that the petitioner has challenged the order under Sections 14B and 17Q which is a composite order before the Central Government Industrial Tribunal, Kolkata on 17.09.2025.

Admittedly there is no regular Presiding Officer at the Tribunal for the last two years and as such the matter has not been taken up for hearing.

In spite of having knowledge of the pendency of the appeal, the respondent authorities are proceeding against the petitioner, taking advantage of the appeal not being heard and the notice dated 22.04.2026 has been issued.

Accordingly, the writ application is disposed of with the direction that the notice dated 22.04.2026 shall remain stayed till the application for stay is taken up for hearing by the learned Tribunal. 7.

Pending hearing before the learned Tribunal, the respondents are restrained from taking any coercive action in respect of the order appealed. 8.

WPA 10749 of 2026 stands disposed of.
