Raju Das @ Jwala v. State Of West Bengal
55.
26-08-2021 (ct. no.32) debajyoti CRM 4439 of 2021 In re: An application for bail under Section 439 of the Code of Criminal Procedure in connection with Newtown Police Station Case No.645 of 2015 dated 23-12-2015 under Sections 489B/489C of the Indian Penal Code.
- A n d - In the matter of : Raju Das alias Jawala .... Petitioner.
Mr. Angshuman Chakrabotry ... For the Petitioner.
Mr. Neguive Ahmed, Mrs. Amita Gaur ... For the State.
The petitioner renews his prayer for bail which was rejected by an order dated November 26, 2019 passed in CRM 11048 of 2019. While rejecting the petitioner's prayer, a coordinate Bench of this Court directed that the trial was to be concluded as expeditiously as possible and preferably, within six months from the next date fixed for recording of evidence without granting unnecessary adjournment to either of the parties.
The charge against the petitioner is of dealing in fake Indian currency notes. This is an offence which has very adverse effect on the country's economy and society at large. The petitioner says that he has been in custody for about six years and eight months. In spite of the direction of a coordinate Bench of this Court, the trial has not only not concluded, no significant progress has also been made in the trial.
The State advocate points out that the prosecution proposes to examine six witnesses only, out of whom two have already been examined.
Keeping in view the very long period of detention of the petitioner, while disallowing his prayer for bail, we request the learned trial Court to make all efforts to bring the trial to its logical conclusion at the earliest without granting unnecessary adjournments to the parties and preferably, within a period of six months from date.
The application for bail being CRM 4439 of 2021 is, thus, dismissed.
All parties shall act on the server copies of this order duly downloaded from the official website of this Court. ( Suvra Ghosh, J. ) ( Arijit Banerjee, J. )
