Ct. No.28 as (Rejected) C.R.M. (A) 2488 of 2022 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Contai P.S. Case No.100 of 2022 dated 01.03.2022 under Sections 498A/304B of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

In the matter of : Satya Kr. Das & Ors.

... Petitioners.

Mr. Navanil De, Mr. Srijan Ghosh, Mr. Subhrajit Dey. ...for the Petitioners. Mr. Saswata Gopal Mukherjee, ld. P.P., Mr. Partha Pratim Das, Mrs. Manasi Roy. .....for the State. Heard the learned Advocates appearing for the parties. We are informed that prayer for discharge has been made so far as the petitioner Nos.3, 4 and 5 are concerned. Hence, the application for anticipatory bail of the said petitioners are disposed of as infructuous.

Having considered the materials on record and bearing in mind the prima facie involvement of petitioner Nos.1 and 2 in torturing the housewife who committed suicide within one year of marriage, we are of the opinion custodial interrogation is necessary and this is not a fit case to grant anticipatory bail to petitioner Nos.1 and 2.

Accordingly, the prayer for anticipatory bail of petitioner Nos.1 and 2 is rejected.
