The petitioner alleges inaction on the part of the CESC authorities in granting connection to the petitioner through a separate service line.

The CESC authorities were directed to cause an inspection. The learned advocate for the CESC authorities submits that there are two separate huts, without any specific demarcation. There is an existing service line in the premises. The respondent no.4 is enjoying connection from one meter board. For safety reasons and as the demarcation of the two huts is not specific, another service line may result in safety hazards. Thus, the CESC authorities are willing to grant connection to the petitioner from the same meter board position, by affixing a separate meter, upon compliance of all formalities.

The learned advocate for the respondent no.4 submits that an eviction suit is pending. The judgment is yet to be delivered.

Under such circumstances, the CESC authorities will supply connection to the petitioner within a month from date

of communication of this order, but such connection shall be subject to the result of the suit and any other civil litigation between the parties.

This is an order of the Court and the respondent no.4 cannot restrain the petitioner from enjoying connection till she remains in the premises. The CESC authorities shall be entitled to seek assistance from the local police authorities, in case they face any difficultly.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

Parties are directed to act on the basis of the server copy of this order.
