Learned advocate appearing for the petitioner prays for bail. Learned advocate appearing for the State has submitted a report. Report reflects that another accused namely, Nandalal Mondal @ Abhay Mondal has been granted bail by the Hon'ble Supreme Court in SLP No. 12788/23. There has been no recovery from the present petitioner and he has been implicated on the basis of the statement of the principal accused.

Learned advocate for the State raises objection, however, police report has been relied upon.

I have taken into account the information furnished in the police report and on an assessment of the same, I am of the opinion that further detention of the present petitioner who is in custody for two years eight months is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed.

As such, the petitioner, namely, Rahul @ Subhankar Das shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (under NDPS Act), 5th Court, Berhampore, Murshidabad.

If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Murshidabad without prior permission of the learned Special Court.

Thus, CRM (NDPS) No. 947 of 2026 is allowed.

Memo of evidence submitted by the State be kept with the record.

Mr. Rajendra Banerjee, learned Additional Public Prosecutor along with Mr. Bankim Pal are appearing for the State. Their appointments may be regularized by the concerned authorities. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
