Meena Mishra And ANR v. Amrita Jamal
June 16, 2023 Sl. No.134 Court No.19 s.biswas CO 1384 of 2023 Meena Mishra and another vs.
Amrita Jamal Mr. Susentjit Banik Ms. Sutapa Mukhopadhyay ... for the petitioners This revisional application has been filed by the plaintiffs for expeditious disposal of Title Suit No.204 of 1994, which is pending before the learned Civil Judge (Junior Division), 2nd Court, Sealdah.
It is submitted by the petitioners that the suit is pending since long and is at the stage of arguments. All inter locutory applications which were filed have already been disposed of. Evidence has been closed. Under such circumstances, this court is of the view that the prayer for expeditious disposal of the suit is justified.
This court has not gone into the merits of the suit. An order of expeditious disposal of any litigation enures to the benefit of all the parties, hence prior service of this revisional application upon the opposite party would not be necessary. The prayer is innocuous.
The revisional application is disposed of with direction upon the learned Civil Judge (Junior Division), 2nd Court, Sealdah to conclude the
arguments in respect of the Title Suit 204 of 1994 and dispose of the same within a period of three months from the next date fixed, without granting any unnecessary adjournment to either of the parties.
Petitioners are directed to serve a copy of this revisional application along with the server copy of this order upon the opposite party.
Accordingly, the revisional application is disposed of.
All the parties are directed to act on the basis of the server copy of this order.
