The petitioner was granted anticipatory bail by this Court on 28th April, 2025 but in the meantime, he was arrested on 25th April, 2025 which was not within the knowledge of either the State or the learned counsel for the petitioner when the anticipatory bail prayer was allowed.

Learned counsel for the State opposes the prayer. A minor boy appears to have committed suicide. The petitioner is the cousin of the girl with whom the boy had a relationship. The father and the uncle of the minor girl have been granted anticipatory bail. Since the petitioner appears to be similarly circumstanced with the co-accused on bail as has also been observed by this Court in granting anticipatory bail to the petitioner, he deserves the same benefit.

Accordingly, the prayer for bail is allowed.

The petitioner namely Ujjal Sk. @ Sumon Saheb be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten

Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Lalbagh, Murshidabad subject to the condition that he shall appear before the Investigating officer as and when called for. He shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event the petitioner fails to adhere to any of the conditions stated above, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.

The application for bail is disposed of.
