Learned advocate appearing for the petitioner submits that the petitioner is in custody for 145 days and there has been no recovery from the present petitioner, although the subject-matter of the case relates to 1.464 kgs. of Brown Sugar.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the petitioner has criminal antecedents. There has been continuous communication between the present petitioner and another co-accused viz. Golam Mostafa. There are other materials to suggest that Golam Mostafa and Anil Chowdhury were continuous in touch with each other during the alleged seizure.

Having regard to the previous conduct of the present petitioner, the quantum of seizure in the present case and the fact that some time will be required by the prosecution to present its case before the learned Special Court, at this stage, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (NDPS) 973 of 2026, is, thus, dismissed.

Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. Mr. Rajendra Banerjee, learned APP along with Mr. Saswata Chatterjee, learned advocate is directed to appear for the State. Their appointment may be regularised by the concerned authorities.
