The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with.

The petitioner is the defendant of Title Suit No. 48 of 1994, a suit for partition which is pending before the 3rd Court of learned Civil Judge (Senior Division), Alipore, District: 24-Parganas (South). The petitioner is in possession of a portion of the Joint Properties of the parties and has filed an application for repair of it.

The petitioner is praying a direction for expeditious disposal of the said application. The learned Trial Judge is requested to dispose of the said application as expeditiously as possible in accordance with law, if the same is otherwise ready for such disposal, and thereafter make all endeavour to bring the Title Suit No. 48 of

1994 to its logical conclusion, and in doing so, shall not grant any unnecessary adjournment to either of the parties.

C.O. 1418 of 2024 is thus disposed of without any order as to costs.

The petitioner shall communicate this order to the opposite parties.
