Learned advocate appearing for the petitioner submits that from the petitioner only 435 grams of Brown Sugar was recovered and the petitioner is in custody for 2 years 3 months. Till date, the prosecution has examined only seven witnesses. There is no chance of the trial being concluded in near future. As such, on any stringent condition, petitioner may be released on bail.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the subject-matter of the case involves recovery of 730 grams of Brown Sugar and the prosecution presently proposes to examine only 12 witnesses.

Having considered that five more witnesses are only to be examined by the prosecution, six months' time is granted to the prosecution. The prosecution witnesses be completed by 15th May, 2026. No unnecessary adjournment be granted to any of the parties and trial of the case would continue in spite of any resolution of the local Bar.

Petitioner would be at liberty to approach this Court for renewal of his prayer for bail after the aforesaid period is over.

Learned advocate for the State is directed to communicate this order to the learned Trial Court. At this stage, the prayer for bail of the petitioner is rejected.

The application for bail, being CRM (NDPS) 552 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
