Mr. Sumanta Ganguly Mr. Rajiv Lochan Chakraborty ....for the petitioners Mr. Krishnendu Bhattacharyya ....Amicus Learned counsel appearing on behalf of the petitioners submits that as per the allegations 34 persons attacked and murdered the victim. The petitioners have been falsely implicated in this case. Learned Amicus assisting the State relies on the case diary and opposes the prayer for anticipatory bail. He submits that all the petitioners were specifically named in the FIR. Their specific roles in perpetrating the crime would be evident from a plain reading of the FIR as also the statements of witnesses including one of the eyewitnesses recorded before the learned Magistrate and present at page 129 of the case diary. He also refers to the post mortem report. The proclamation has also been issued against the petitioners on 14.04.2026.
Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
The application for anticipatory bail is, thus, rejected.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
