The report reveals that the respondent/complainant, Tumpa Aditya and her family are not residing in the petitioner's house nor in its vicinity since 2017 as revealed in the local enquiry. Police has reported that their present whereabouts also could not be ascertained.
It appears that the impugned order dated 26.7.2017 was passed more than eight years back by which the direction was made upon the petitioner herein for furnishing bond for keeping peace. Since the police report reveals that the present whereabouts of the complainant is not ascertainable and moreover, she does not reside within the vicinity, I find that the relevancy of the order as well as the proceeding has become infructuous.
Since the impugned order along with order passed by the Executive Magistrate has become obsolete, due to long lapse of
time, the order of the Executive Magistrate dated 26.7.2017 and the order of the Trial court dated 19.5.2018 are hereby set aside. CRR 1504 of 2018 is accordingly disposed of. Connected application, if any, is also disposed of.
