1. Sufficient grounds are available to explain the absence of the petitioner and/or his Counsel on 22nd September, 2023 before a Co-ordinate Bench of this Court.

2. The said order is recalled and the writ petition is restored to its file and number.

3. Accordingly, CAN 1 of 2024 is disposed of.

4. There will be, however, no order as to costs. Re: W.P.A. No. 10314 of 2023

1. Affidavit-of-service filed in Court today be taken on record.

2. The petitioner retired from service on 31st December, 2010. The petitioner claims interest on delayed payment of arrears of pension.

3. This Court has decided the entitlement of the employee on delayed payment of arrear pension by

judgments and orders dated 15th April, 2024 and 31st April, 2024 passed in WPA 2889 of 2024 (Swapan Kumar Chakraborty - Vs. - The State of West Bengal & Ors.).

4. Let interest at the rate of 7% per annum be paid to the petitioner from the date of superannuation till the date of actual payment on the said arrears, within a period of one month from date. In default of payment of arrears within the period as aforesaid, the rate of interest shall increase to 9% per annum.

5. With the aforesaid directions, the instant writ petition shall stand disposed of.

6. There will be no order as to costs.

7. The petitioner shall communicate a copy of this order along with the instant writ petition to the Director of Pension, Provident Fund and Group Insurance, West Bengal.

8. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
