Learned advocate appearing for the petitioner submits that private respondents embezzled funds of the society. Two complaints to the police did not evoke any response. One of the complaints was registered as first information report. The private respondents are dealing with the evidences available in order to prejudice the investigation. The police are inactive.

The State and private respondents are represented.

Learned advocate appearing for the State submits that, the investigation with regard to the first information report registered is in progress.

Learned advocate appearing for the petitioner submits that although the police registered first information report with regard to one of the complaints, other complaint is yet to be registered as first information report.

So far as the other complaint of the petitioner is concerned, which the police did not register as first information report, the petitioner can avail the remedies under the provisions of Section 156(3) of the Code of Criminal Procedure.

It appears that there are disputes between the private parties with regard to the management of a society. There are claims and counter-claims by the private parties against each other. The present complaint of the petitioner which was registered as first information report is under investigation. No doubt, the police will conduct the investigation in accordance with law and submit its report before the jurisdictional court as expeditiously as possible. No further interference is called for by the writ court. Accordingly, WPA 11000 of 2021 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance of the requisite formalities.
