Petitioner is aggrieved by the fact that the police authorities are not conducting fair and impartial investigation into the allegations made by the petitioner which were sent vide letter dated 03.04.2025.

Police has submitted a report which reflects that Nadial PS Case No. 69 dated 03.04.2025 has been registered for investigation under the relevant provisions of the BNS. Statement of the complainant was recorded. The petitioner and other accused persons surrendered before the learned ACJM, Alipore and obtained bail. The present petitioner preferred an application under section 175(3) BNSS wherein the learned Court considered the application of the petitioner under section 175(3) BNSS and directed the Officer-in-charge, Nadial

Police Station to conduct an enquiry and date has been fixed on 09.06.2025.

Having considered the steps taken by the police authorities which included the communication to the Deputy Commissioner of Police and the RTI application which has also been preferred, I am of the view that since only one and half months have commenced since the initiation of the investigation at this stage no interference is called for.

Petitioner would be at liberty to approach this Court after the documents are handed over to the petitioner on conclusion of investigation of the case.

With the aforesaid observations WPA 10282 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
